In 1988, Congress and the President enacted legislation that created the Defense Nuclear
Facilities Safety Board (Board), "an independent establishment in the Executive Branch" to
recommend to the Secretary of Energy, actions "the Board determines are necessary to ensure
adequate protection of public health and safety."
